Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of Pictorx, our online photo and image editor ("the Editor"), operated by Fotoview in the Netherlands. By accessing or using the Editor, you agree to these Terms. If you do not agree, do not use the Editor.

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

2. The Service

Pictorx lets you create, edit, and export images and designs in your browser. Features may include local editing, optional account sign-in, cloud-connected integrations (such as Google Drive), templates, and paid subscription plans.

We may change, suspend, or discontinue any part of the Editor at any time. We try to keep the service available, but we do not guarantee uninterrupted or error-free operation.

3. Accounts

You may sign in with Google, Facebook, Microsoft, or email and password. You are responsible for activity on your account and for keeping your credentials secure.

You must provide accurate account information and promptly update it if it changes. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent, abusive, or unlawful.

4. Your Content

You retain ownership of images, designs, and other content you create or upload ("Your Content"). You are solely responsible for Your Content and for ensuring you have the rights needed to use, edit, export, and share it.

Unless you explicitly use a feature that stores content on our servers, Your Content is processed in your browser and is not uploaded to us.

You grant Fotoview a limited license to process Your Content only as needed to provide the Editor, including when you choose to open a file from Google Drive or another connected service.

5. Google Drive and Third-Party Services

If you connect Google Drive or another third-party service, you authorize us to access only the data needed for the feature you request, such as opening a file you select in the Google Drive picker.

Third-party services are governed by their own terms and privacy policies. Fotoview is not responsible for third-party services, outages, or changes made by those providers.

6. Acceptable Use

You agree not to misuse the Editor. For example, you must not:

  • violate applicable law or third-party rights;
  • upload or process unlawful, infringing, deceptive, or harmful content;
  • attempt to gain unauthorized access to our systems or other users' accounts;
  • interfere with or disrupt the Editor, including by automated scraping or abuse;
  • reverse engineer or circumvent technical limits except where permitted by law.

7. Subscriptions and Payments

Some features may require a paid subscription. Prices, billing intervals, and included features are shown before purchase. Payments are processed by our payment providers; their terms also apply.

Unless required by applicable consumer law, fees are non-refundable once a billing period has started, except where we expressly state otherwise or where a refund is required by law.

8. Intellectual Property

The Editor, including its software, branding, templates, and documentation, is owned by Fotoview or its licensors and is protected by intellectual property laws.

These Terms do not grant you any right to use Fotoview trademarks or branding except as needed to use the Editor in the ordinary course.

9. Disclaimers

The Editor is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that exports, edits, or integrations will meet your requirements or be free from loss or corruption.

10. Limitation of Liability

To the fullest extent permitted by law, Fotoview is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Editor.

Where liability cannot be excluded under mandatory law, our total liability for any claim relating to the Editor is limited to the greater of (a) the amount you paid us for the Editor in the 12 months before the claim or (b) EUR 50.

11. Termination

You may stop using the Editor at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the service, users, or Fotoview. Sections that by their nature should survive termination will continue to apply.

12. Governing Law and Contact

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the competent courts in the Netherlands, unless mandatory consumer law gives you different rights.
